IMPARTIAL ANALYSIS BY COUNTY COUNSEL

MEASURE R

(ZAYANTE FIRE PROTECTION DISTRICT ORDINANCE NO. 1999-1)

      This measure, if approved by a majority of those voting, would permit the Zayante Fire Protection District to increase its annual Proposition 4 spending limitation for four years.

      Existing law, enacted in 1979 as part of Proposition 4 (now California Constitution Article XIIIB), restricts governmental spending by setting an annual appropriations (i.e., expenditures) limit for governmental agencies. The California Constitution authorizes voters to change that limit. Unless the voters do so, the appropriations limit is otherwise based on the prior year’s limit, adjusted for changes in the cost of living and population.

      The proposed ordinance does not authorize the District to impose a new assessment or increase the property tax rate. Instead it authorizes an increase in the District’s annual spending limit for four years so that the permitted total would be equal to the sum of revenues from specified sources.

      A "yes" vote on Measure R is a vote to increase the District’s appropriations (expenditures) limit.

      A "no" vote on Measure R is a vote against increasing the District’s appropriations (expenditures) limit.
